Certling Affiliate Programme

Terms & Conditions

These Terms & Conditions (“Terms”) govern participation in the Certling Affiliate Programme (“Programme”). By applying to or participating in the Programme, you (“Affiliate”, “you”, “your”) agree to be bound by these Terms.


1. About Certling

Certling is an online certified translation platform providing certified translations into English for official, legal, academic, immigration, and professional use, including for institutions in the United Kingdom, United States, Ireland, and other English-speaking jurisdictions.


2. Eligibility & Application

2.1 Participation in the Programme is subject to approval by Certling.
2.2 Certling reserves the right to accept or reject any application at its sole discretion.
2.3 Certling may request additional information regarding intended promotional methods before approving an application.
2.4 Participation may be refused or revoked where promotion methods do not align with Certling’s values of transparency, fairness, and lawful marketing.


3. Affiliate Relationship

3.1 Affiliates act as independent promoters.
3.2 Nothing in these Terms creates an employment relationship, partnership, agency, or joint venture between the Affiliate and Certling.
3.3 Affiliates are not authorised to act on behalf of Certling or bind Certling in any way.


4. Commission Structure

4.1 Affiliates may earn up to 20% commission on qualifying sales generated through their unique tracking links.
4.2 Commission is calculated on the net order value, excluding VAT, refunds, chargebacks, credits, cancellations, or failed payments.
4.3 Commission is only earned once payment has been successfully received by Certling and the order is not subject to refund or dispute.
4.4 Certling reserves the right to reverse or withhold commissions where an order is refunded, cancelled, charged back, fraudulent, or in breach of these Terms.
4.5 Certling’s tracking, attribution, and commission calculations are final and binding.


5. Discounts & Commission Flexibility

5.1 Affiliates may choose to offer discounts to their audience using part or all of their commission.
5.2 Any discount offered is deducted from the 20% commission pool.
5.3 Affiliates may not offer discounts exceeding the maximum commission available.
5.4 Unauthorised discounts, incentives, or rebates are strictly prohibited.

Example:
- Maximum commission: 20%
- Discount offered: 8%
- Commission earned: 12%


6. Tracking & Attribution

6.1 Approved Affiliates will receive a unique tracking link.
6.2 Only sales correctly tracked through official Certling affiliate links are eligible for commission.
6.3 Certling is not responsible for lost commissions due to incorrect link usage, technical issues, browser restrictions, ad blockers, or user error.


7. Self-Referrals & Fraud

7.1 Affiliates may not refer themselves, their own business, employees, household members, or any entity under their control.
7.2 Any attempt to artificially generate commissions, including self-referrals, false leads, or manipulation of tracking systems, constitutes fraud.
7.3 Fraudulent activity will result in immediate termination and forfeiture of all unpaid commissions.


8. Permitted Promotion Methods

Affiliates may promote Certling through lawful and transparent means, including:

- Websites and blogs
- Editorial or informational content
- Opt-in newsletters
- Social media platforms
- Online communities managed or moderated by the Affiliate
- Educational or informational resources

All promotions must be accurate, honest, and not misleading.


9. Prohibited Activities

Affiliates must not:

- Misrepresent Certling, its services, pricing, or acceptance criteria
- Claim or imply guaranteed acceptance by any authority or institution
- Provide legal, immigration, or official advice on behalf of Certling
- Present themselves as employees, agents, or official representatives of Certling
- Use spam, unsolicited messages, or deceptive marketing practices
- Bid on Certling brand keywords or close variations in paid advertising
- Use Certling or similar terms in display URLs, domain names, subdomains, or social media handles
- Create websites or landing pages designed to impersonate Certling
- Offer unauthorised discounts, incentives, or rebates
- Make misleading comparisons or false urgency claims
- Engage in any activity that may reasonably damage Certling’s reputation, brand, or legal standing

Certling reserves the right to withhold or reverse commissions arising from prohibited activity.


10.1 Affiliates must comply with all applicable advertising, consumer protection, and disclosure laws.
10.2 Where required by law (including FTC or equivalent regulations), affiliate relationships must be clearly disclosed.
10.3 Affiliates are solely responsible for ensuring compliance with local laws and regulations.


11. Intellectual Property

11.1 Certling grants Affiliates a limited, non-exclusive, revocable licence to use approved Certling branding and materials solely for promoting Certling.
11.2 All intellectual property remains the property of Certling.
11.3 Upon termination, all Certling branding, links, and promotional materials must be removed immediately.


12. Payments & Tax

12.1 Affiliates are responsible for providing accurate payment details.
12.2 Affiliates are solely responsible for declaring and paying any taxes arising from commissions earned.
12.3 Certling may request tax or identity information where legally required.


13. Termination

13.1 Either party may terminate participation in the Programme at any time, with or without notice.
13.2 Certling may terminate participation immediately in cases of breach, fraud, misrepresentation, or unlawful promotion.
13.3 Upon termination: - All promotional activity must cease immediately
- All Certling branding, links, and materials must be removed
- Any unpaid commissions arising from prohibited or fraudulent activity are forfeited
- Certling may withhold payment of outstanding commissions pending investigation


14. Modifications

14.1 Certling may update or modify these Terms at any time.
14.2 Continued participation in the Programme constitutes acceptance of the updated Terms.
14.3 The latest version will always be published on the Certling website.


15. Limitation of Liability

To the fullest extent permitted by law, Certling shall not be liable for loss of revenue, loss of profits, indirect damages, or tracking or technical errors outside its reasonable control.


16. Force Majeure

Certling shall not be liable for failure or delay in performance caused by events beyond its reasonable control, including technical failures, third-party service interruptions, or legal or regulatory changes.


17. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.


18. Waiver

Failure by Certling to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.


19. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
